STANDARD TERMS AND CONDITIONS
 
1. GENERAL
1.1 The present standard e-store terms and conditions (henceforth Terms) are valid between OÜ RTC FEELER, registry code 10495511, kapotiamordid.ee (pneumatics.ee, pneumatics.lt, pneumatics.lv, pneumaticauto.eu) and every person entering a legal relationship upon purchasing products from aforementioned e-stores. OÜ RTC FEELER starting the process of filling a contract indicates that they agree with the contract. OÜ RTC FEELER retains the right to cancel the order if they find the need to be.
1.2  The customer is obliged to familiarize themselves with the Terms. The customer hereby confirms that they have familiarized themselves with the Terms and the Pricelist and that the Terms and the Pricelist are fully understood.
1.3 Sides of the contract are guided by the Law of Obligations Act and other legal acts of the Republic of Estonia and kapotiamordid.ee (pneumatics.ee, pneumatics.lt, pneumatics.lv, pneumaticauto.eu) by the e-store Terms agreed upon.
1.4 OÜ RTC FEELER retains the right to modify and supplement the Terms and the Pricelist of kapotiamordid.ee (pneumatics.ee, pneumatics.lt, pneumatics.lv, pneumaticauto.eu) in the interests of better and safer usage of the e-store. The modifications and supplements come into effect the moment they have been published on the site www.kapotiamordid.ee ( www.pneumatics.ee ,www.pneumatics.lt ,www.pneumatics.lv , www.pneumaticauto.eu ). If the customer placed an order before the supplements or modifications came to effect, the old Terms and Pricelist are applied to the customer unless stated otherwise by the Law or the Terms.
1.5 The following definitions are used in the Terms:
Customer – the user of the service, one side of the contract, a physical or legal person who has placed an order and entered a purchase and sale agreement.
Sides – the user of the e-store on one side and OÜ RTC FEELER, as the fulfiller of the order, on the other side.
Duties – the sum of money to be paid by the customer on the basis of the purchase and sales agreement.
Payment Deadline – the date by which the Duties must be transferred to the bank account of the e-store.
Business Day – a day that is not a Saturday, Sunday or a National Holiday or a State Holiday, lasting from 9:00 to 17:00.
Order – a form with the required data (surname, forename, contact telephone, contact e-mail, delivery address, postal code, car brand and year of manufacturing and the product code from the e-store)
 
2. FORMALIZATION OF THE ORDER AND MAKING A PURCHASE
 
2.1 The products of kapotiamordid.ee (pneumatics.ee, pneumatics.lt, pneumatics.lv, pneumaticauto.eu) are available for purchase to both physical and legal persons.
2.2 The customer fills out the required form with the required data (surname, forename, contact telephone, contact e-mail, delivery address, postal code, car brand and year of manufacturing and the product code from the e-store). The customer will be redirected to the customer data page.
2.3 The customer enters the required data on the customer data page and will be redirected to an order confirmation and payment method selecting page.
2.4 It is very important to take care when entering the data on the page with the customer data and the order confirmation page because the fulfilment and trouble-free delivery of the order is dependent on the accuracy of the data entered on said pages.
2.5 The purchase and sales agreement of the products enters into force on the moment the sum of money defined on the order confirmation is received on the bank account of OÜ RTC FEELER.
2.6 The customer chooses the delivery service provider or other method of delivery during the order. The delivery expenses are added to the Duties.
 
3. PRICE
 
3.1 All the prices found at kapotiamordid.ee (pneumatics.ee, pneumatics.lt, pneumatics.lv, pneumaticauto.eu) e-store are in euros and include VAT.
3.2 The prices found at kapotiamordid.ee (pneumatics.ee, pneumatics.lt, pneumatics.lv pneumaticauto.eu) e-store are valid if the invoice is paid on time.
3.3 OÜ RTC FEELER retains the right to change the prices found in the e-store at any time. If the prices listed in the e-store have changed after the customer placed an order and paying the invoice, OÜ RTC FEELER is obliged to deliver the products to the customer based on the prices found in the e-store before the changes were implemented.
3.4 The delivery costs of the products ordered are listed at www.kapotiamordid.ee   (www.pneumatics.ee ,www.pneumatics.lt ,www.pneumatics.lv , www.pneumaticauto.eu )  in the section “delivery service” and are dependent on the delivery service provider, method of delivery and the location.
 
4. PAYING FOR THE PRODUCTS
 
4.1 The customer specifies their preferred method of payment on the order placement page.
4.2 The payment methods are:
4.2.1 A bank links (Swedbank; SEB; Norda; DNB; Danske Bank; LHV and others )
4.2.2 An invoice. By clicking on “pay with invoice” an order confirmation is sent to the customer’s e-mail. The payment confirmation will be sent after paying for the order.
4.2.3. Creditcard or paypal
4.3 The order will be cancelled if a payment to the bank account of OÜ RTC FEELER for the order is not received within 5 working days.
4.4. Payment in e-shop is done through system Maksekeskus AS. The receiver of the payment is Maksekeskus AS. Maksekeskus AS is not considered as a party involved in the agreement between client and RTC Feeler OÜ.

 
5. FULFILLING THE ORDER, DELIVERY AND HANDOVER OF THE PRODUCTS
 
5.1 The products will be delivered to the Customer via the method specified in the order.
5.2 The products will be delivered to the customer after specifying the method and company of delivery after the contract’s entry into force according to subsection 2.6 of present Terms and by the date specified on the order. If the product is available in storage, the order will be fulfilled in 3 Business Days and delivered in 5-7 Business Days, depending on the delivery service provider. If the product needs to be manufactured prior to delivery, the order will be fulfilled within 30 Business Days after the contract’s entry into force. Should the Customer lose interest in purchasing the product due to the long delivery time, the Customer retains the right to cancel the order and the Customer will be reimbursed for all the costs of the order.
5.3 Changing the delivery address is not permitted after placing and paying for the order.
5.4 When placing the order please observe that the correct data is provided in order to avoid delays or misunderstandings with the delivery. The delivery service provider nor OÜ RTC FEELER are not to be held responsible for any delays or misunderstandings with the delivery of the products, if the delays or misunderstandings stem from false data provided by the Customer.
 
6. CANCELLING THE ORDER AND RETURNING THE PRODUCT
 
6.1 The customer retains the right to cancel the order after paying for it but prior to its delivery, by sending a corresponding notice to the e-mail of the e-store info@pneumatics.ee , which includes the order number and their bank account number.
6.2 After receiving the products the Customer has 14 days to familiarize themselves with the product. Should it happen that the product is not fit for them, they retain the right to return the product during the 14 days or have it exchanged for another product by sending a corresponding notice to the e-mail address of the e-store info@pneumatics.ee.
6.3 The returned products must be complete (it must include the packaging and everything found within the packaging).
6.4 OÜ RTC FEELER retains the right reduce the reimbursement value or to decline the return of products with evidence of mechanical damage or damage stemming from usage. The reimbursement application shall be sent by OÜ RTC FEELER to the Client to the address specified on the order form. Should the customer not be satisfied with the amount of reimbursement, they retain the right to hire an expert to evaluate the monetary value of the damage. The expenses associated with said expert are to be covered by the Customer.
6.5 Upon cancelling the order as described in subsection 6.1 or returning the product as described in subsection 6.2 the Customer will be reimbursed to the full extent. The money shall be transferred by OÜ RTC FEELER in 14 days to the account, from which the money paid for the order originally originated from, provided that the product was returned during 14 days, except for the case described in subsection 6.3.
6.6. Custom made products or products produced taking into account the customers’ special demands are not eligible to our return policy.
 
7. GUARANTEE AND RETURNING UNACCEPTABLE PRODUCTS
7.1 OÜ RTC FEELER takes full responsibility for any imperfections or mismatches that may appear during the 2 years following the delivery of the product.
7.2 OÜ RTC FEELER is not responsible for:
7.2.1 Damages occurring on the customer’s fault.
7.2.2 Damages or shortcomings that stem from misusage of the product.
7.2.3 The physical deterioration stemming from normal use of the product
7.3 The Customer retains the right to claim for a replacement product or back out from the order and return the imperfect product, should the product be faulty or imperfect.
7.4 In the case of returning an imperfect product, the Customer shall be reimbursed to the full extent in 14 days following the return of the imperfect product.
 
8. PERSONAL DATA AND ITS USAGE
 
8.1 Only the data required to fulfil the order are asked from the Customer at making a purchase atKapotiamordid.ee (pneumatics.ee, pneumatics.lt, pneumatics.lv, pneumaticauto.eu). The Customer gives a conscious and clear agreement to OÜ RTC FEELER to process the data.
8.2 The personal data provided by the Customer shall be entered into the customer database of OÜ RTC FEELER and will be used for future marketing and sales purposes.
8.3 The data entered into the customer database consists of the following: ID number, surname, forename(s), street, house, apartment number, town or city, postal code, phone number, e-mail address, year of birth, sex, delivery method, preferred payment method, agreement of the Terms and Conditions, agreement of receiving Marketing offers, miscellaneous text found in e-mail correspondence.
8.4 All the customer data is concerned to be confidential. An encrypted data channel is to be used when communicating with the bank to ensure the full confidentiality of personal banking data. OÜ RTC FEELER has no access to it.
8.5 Customer data needed to perform a delivery are forwarded to the delivery service provider.
8.6 OÜ RTC FEELER hereby confirms that the protection of customer data is guaranteed using every possible legal device and also that OÜ RTC FEELER is prohibited from disclosing customer data to uninvolved Third Parties.
8.7 OÜ RTC FEELER retains the right to forward customer data to Third Parties who have the legal right to it and process the data due to a legal obligation or to Third Parties who have the legal right to it and process the data to guarantee the safety or life of the Customer or anyone else involved.
8.8 The Customer retains the right to check the personal data concerning them, to request their alteration or removal from the customer database.
8.9 Upon placing an order the Customer gives OÜ RTC FEELER the agreement to send an order confirmation on the address found on the order form.
 
9. RESPONSIBILITY
 
9.1 OÜ RTC FEELER is responsible in front of the Client and the Client is responsible in front of OÜ RTC FEELER for any damage stemming from the violation of present Terms in the cases and extents found in the legislation of the Republic of Estonia.
9.2 OÜ RTC FEELER is not responsible for any damage caused to the Customer, or any delays concerning the delivery of the product if the damage or delay is caused by factors not in power of OÜ RTC FEELER.
9.3 Any disagreements not covered by present Terms are to be solved on the basis of the legislation of the Republic of Estonia.
9.4 Any disagreements stemming from ordering or purchasing products from the e-store are to be solved with negotiations. Should the terms of the negotiations be unfitting for the Customer, the Customer retains the right to turn to the Consumer Protection Commission or Harju County Court via the Consumer Protection Board. The Customer may lodge a complaint themselves or via a representative. Disagreements are to be solved on the basis of the legislation of the Republic of Estonia.
